TenGrade Terms of Service
Last updated: 30 September 2026
These terms govern use of TenGrade, a product of Fibtec Limited (“Fibtec”, “we”, “us”), by any organisation or individual that creates an account (“you”, an “Examiner” in these terms, regardless of your specific role within your organisation). By creating an account or using TenGrade, you agree to these terms on behalf of yourself and, if applicable, the organisation you represent.
1. What TenGrade is — and isn’t
TenGrade grades open-ended exam answers. It scores a candidate’s answer against a reference answer you provide, on the skills you weight, and produces a report. TenGrade does not hire, does not rank candidates against each other for decision-making purposes, and does not participate in your hiring or assessment process in any way. You retain full and exclusive responsibility for any decision you make using TenGrade’s output — a score is information for you to use as you see fit, within whatever legal and professional obligations apply to your own decision-making; it is not itself a decision, and TenGrade is not a party to whatever decision you reach.
You are responsible for ensuring you have an appropriate legal basis and, where required, appropriate consent for administering exams to your candidates, including where a candidate is a minor — TenGrade is a tool for that process, not a substitute for your own obligations around it.
2. Your account and organisation
- Signing up with an email address at a given domain for the first time makes you the Owner of a new organisation on TenGrade. Every subsequent person who signs up with an email at that same domain joins as an Examiner by default; an Owner can grant Auditor access separately.
- You’re responsible for keeping your account credentials confidential and for all activity under your account.
- We reserve the right to decline or terminate an account that we believe in good faith is being used fraudulently, abusively, or in violation of these terms.
3. Fees, credit, and the free plan
- TenGrade is billed on a pay-as-you-go credit basis: your organisation purchases credit, and grading, AI-assisted question generation, and candidate invitations draw down against that balance at the rates shown in the product at the time of use. Pricing may change; we’ll show the current rate before any action that spends credit.
- New organisations start with trial credit and a free plan with reasonable size and volume limits, described in the product itself. We may change the specifics of the free plan going forward, but won’t reduce what an organisation already has access to as a result.
- Purchased credit is non-refundable once spent, and we do not guarantee any particular exchange rate or bonus on credit bundles beyond what’s shown at the time of purchase.
- Payment is processed by Stripe; by making a payment you also agree to Stripe’s own terms for that transaction.
4. Acceptable use
You agree not to use TenGrade to:
- Administer an exam or collect candidate content for any unlawful purpose, or in a way that violates a candidate’s own legal rights;
- Attempt to identify a candidate through means outside TenGrade and then hold TenGrade responsible for a link you made yourself;
- Attempt to circumvent, probe, or interfere with TenGrade’s security, including the anonymity architecture described in our Privacy Policy;
- Resell or provide TenGrade’s service to a third party as your own offering, without our separate written agreement.
5. Candidate anonymity, and the one exception
TenGrade is built so that a candidate’s exam attempt is never linked to their real-world identity within our own systems (see our Privacy Policy §3 for the technical detail). As the examiner organisation, you may of course separately know which of your own candidates a given link was sent to — that correspondence is entirely outside TenGrade and is your own responsibility to manage appropriately.
Fibtec retains an internal technical mapping as an operational necessity of running the service, and will only use or disclose it under exceptional circumstances: a legal obligation such as a court order or statutory request, a good-faith investigation into suspected fraud affecting the platform, or a genuine threat to the integrity of the platform itself. This is a narrow safeguard exercised at Fibtec’s sole discretion in those specific circumstances — it is not something an examiner organisation can request as a matter of routine, and using TenGrade does not give you a right to that mapping.
6. AI grading — what to know before you choose a tier
Grading, AI-assisted question drafting, and the narrative review text on a report are generated using third-party AI models (Anthropic’s Claude models). We choose the specific model per grading tier your organisation selects. If you choose our Premium tier (Opus or Fable models), those specific calls are subject to Anthropic’s own standard 30-day data retention policy for safety-monitoring purposes — a longer window than our Standard tier. This doesn’t compromise candidate anonymity (no identifying information is ever included in what’s sent, regardless of tier), but it’s a real difference in how long that content exists outside our own systems, and you should factor it into your own choice of tier.
AI-generated scores and text are produced by a language model and, like any such system, can be wrong, incomplete, or reflect the model’s own limitations. You are responsible for reviewing output before relying on it for any consequential decision.
7. Optional add-ons
- SEB (Safe Exam Browser) lockdown and webcam/AI proctoring are optional, separately-priced features you can enable per exam or per invitation. Enabling either is your own choice and your own responsibility to disclose to candidates as appropriate under your own obligations to them.
- Blockchain anchoring is an optional feature that publishes a cryptographic hash of an exam’s result record to a public blockchain ledger, as a tamper-evidence mechanism. Only a hash is published — never the underlying content — but once anchored, a record’s hash is permanent and cannot be removed from the public ledger it was anchored to, even if you later delete your own copy of the underlying data.
8. Data retention and deletion
As described in our Privacy Policy, we do not automatically delete exam records, results, or billing history — this preserves the integrity of your own historical reports and is required for our anchoring feature to mean what it claims to mean. Instead, your organisation’s Owner can request full, permanent deletion of the organisation and all of its data at any time, directly through our platform’s API — a deliberate, explicit action, confirmed against your organisation’s own domain, never something that happens as a side effect of ordinary use. Once confirmed, this permanently deletes every exam, instance, result, member account, and billing record, and cannot be undone.
Deletion does not reach everything: the on-chain hash of any exam you previously chose to anchor (§7 above) remains on the public ledger it was published to — that ledger cannot be edited by us or anyone else, and an orphaned hash reveals nothing once the record behind it is gone. Deletion also does not affect Stripe’s own independent transaction records for payments you made. If you need help with a deletion request, or want it handled on your behalf, contact us at info@fibtec.co.uk.
9. Service availability
We aim to keep TenGrade available and will communicate about planned maintenance and incidents through our status page, but we do not guarantee uninterrupted availability, and TenGrade is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, about the service’s fitness for a particular purpose or accuracy of AI-generated content.
10. Limitation of liability
To the maximum extent permitted by law, Fibtec’s total liability to you arising out of or relating to these terms or your use of TenGrade will not exceed the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential damages, including decisions you make based on TenGrade’s output — see §1. Nothing in these terms limits liability that cannot be limited under applicable law (including liability for death or personal injury caused by our negligence, or for fraud).
11. Intellectual property
TenGrade’s software, design, and the “Iron Triangle” scoring framework remain Fibtec’s property. You retain ownership of the exam questions, target answers, and organisational content you upload; you grant us a licence to process it solely to provide the service to you.
12. Termination
Either party may terminate at any time; your organisation’s remaining credit balance is non-refundable on termination unless required otherwise by law. Sections that by their nature should survive termination (including §5, §8, §10, and §11) continue to apply.
13. Changes to these terms
We’ll update the date at the top of this page when these terms change, and make reasonable efforts to notify account holders of material changes before they take effect.
14. Governing law
These terms are governed by the laws of England and Wales, and any dispute is subject to the exclusive jurisdiction of the courts of England and Wales, matching Fibtec Limited’s own registration.
